Liability Waiver, Agreement, Release and Assumption of Risk

Acknowledgment of Risks:

I, the over-signed, acknowledge that my participation in activities (training and instruction, including but not exclusively in aerial silks and other disciplines) at Eagle's Nest Atitlán may imply inherent risks, including but not limited to, emotional or physical injury, property damage, damage to myself or to third parties, paralysis, death or other harm. These risks include, but are not limited to:

• Use of outdoor facilities including hiking trails, compost toilets, and outdoor showers.
• Participation in yoga, meditation, sauna sessions, workshops, and other events.
• Possible contact with insects, wildlife, and natural elements.
• Use of any equipment provided by Eagle's Nest Atitlán.

I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity and the negligence of other participants or persons who may be present are not the fault of Eagle’s Nest.

Release of Liability:

In consideration of staying at Eagle's Nest Atitlán and participating in its activities, I release and waive any claims against Eagle's Nest, its owners, staff, and agents for liability, including personal injury, property damage, or wrongful death. I understand and accept the risks involved, and I take full responsibility for any resulting losses, costs, or damages.

I understand that if I bring my own equipment to train on or with then it is my sole responsibility to ensure that that equipment is safe for use and I must have my own public liability insurance policy in place in order to do so. If I allow anyone else to train on or with my own equipment I will make it clear that it is my own equipment and does not belong to the Activities organizers, and I assume sole responsibility for its use. I understand that if I train on equipment that is not owned by the Activities organizers then I do so entirely at my own risk.

Medical State and Treatment:

I understand that I am qualified, in good health, and in proper physical condition to participate in this activity. I acknowledge that physical adjustments may be made by the teacher or assistant to enhance or correct my posture, and I am responsible for informing them of any injuries or impairments, or if I prefer not to receive such adjustments. In case of an emergency, I authorize Eagle's Nest Atitlán to obtain necessary medical treatment from licensed professionals and agree to cover all associated costs.

Image use consent / Non-Commercial Use of Photography or Video:

I hereby grant Eagle's Nest Atitlán permission to use photographs and videos of me/my child. These images may appear in publications, promotional materials, internal staff training manuals, and on the internet, including on their website and social media platforms such as Twitter, Instagram, and Facebook. I understand and agree that these images will become the property of Eagle's Nest Atitlán and authorize them to edit, copy, exhibit, publish, or distribute these images for any lawful and moral purpose.

I also acknowledge and consent to the following:

• Eagle's Nest Atitlán retains the rights to use any images or videos taken during my stay/visit for promotional purposes.
• I must refrain from using the name "Eagle's Nest" in any promotional content.
• I must not use pictures or videos depicting Eagle's Nest for self-promotion, whether paid or unpaid, without prior approval from the founder or management department.
• I must not use the Eagle's Nest logo without permission.
• I should avoid any direct or indirect references or implications of a connection or endorsement by Eagle's Nest in promotional materials.

Acceptance of Terms:

I confirm that I will follow instructions from Eagle's Nest staff to ensure physical, emotional, and verbal safety. I acknowledge that I have read and fully understand this release of liability, waiver of claims, assumption of risks, and indemnity agreement. I recognize that by signing this agreement, I am giving up substantial rights, including my right to sue, and I do so freely and voluntarily, intending to release all liability to the greatest extent allowed by law.

My participation in any activities at Eagle’s Nest is purely voluntary, and I choose to participate despite the risks. I agree to engage in the activities in a manner that does not endanger myself or others. I understand that while there is an area provided for personal belongings during class, Eagle's Nest Atitlán is not responsible for any loss or damage to my belongings. I acknowledge my obligation to immediately discontinue any activity and inform the instructor of any pain, discomfort, fatigue, injury, limitations, or other problems before, during, and immediately after my participation.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical conditions I may have.
