Liability Waiver, Agreement, Release and Assumption of Risk

I acknowledge that my participation in aerial arts training and instruction, including aerial silks and other aerial disciplines entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity and the negligence of other participants or persons who may be present.

My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I will participate in the Activities in a manner that does not endanger either me or others. I understand that an area for personal belongings is available during class, however, I agree that Eagles Nest Atitlan is in no way responsible for the loss or damage of any of my belongings while I attend class.

I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I understand that I may receive physical adjustments to enhance or correct my body posture or position during class by either the teacher or an assistant. I take accountability for alerting the teacher or assistant of any injury or impairment that may be affected by these adjustments, or if I do not want to receive any assists.

I understand the scope, nature and extent of the risks involved in this activity and voluntarily and freely choose to assume any and all such risks and I fully accept all responsibility for losses, cost, and damages I incur as a result of my participation in this activity.

I ACKNOWLEDGE MY OBLIGATION TO IMMEDIATELY DISCONTINUE ANY ACTIVITY AND INFORM THE INSTRUCTOR OF ANY PAIN, DISCOMFORT, FATIGUE, INJURY, LIMITATIONS OR OTHER PROBLEMS OR SYMPTOMS THAT I MAY SUFFER OR BECOME AWARE OF BEFORE, DURING, AND IMMEDIATELY AFTER MY PARTICIPATION.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical conditions I may have.

I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Eagles Nest Atitlan from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of their equipment or facilities, including any such claims which allege negligent acts or omissions.

I understand that if I bring my own equipment to train on or with then it is my sole responsibility to ensure that that equipment is safe for use and I must have my own public liability insurance policy in place in order to do so. If I allow anyone else to train on or with my own equipment I will make it clear that it is my own equipment and does not belong to the Activities organizers, and I assume sole responsibility for its use. I understand that if I train on equipment that is not owned by the Activities organizers then I do so entirely at my own risk.

I understand that if, in the Activities organizers’ opinion, my behavior is unsafe, disruptive or otherwise inappropriate then I may be asked to cease participating and/or leave the premises. I understand that I have no right to continue participation in the Activities if this happens, and I will not be refunded or compensated.

I hereby grant Eagles Nest Atitlan permission to use my/my child’s photographs and video. These images may appear in publications, promotional material, internal staff training manuals and on the internet. I understand and agree that these images will become the property of Eagles Nest Atitlan and I hereby irrevocably authorize them to edit, copy, exhibit, publish or distribute these images for any lawful and moral purpose. I acknowledge these may be used on their website and other social media such as Twitter, Instagram and Facebook, in newsletters and publications.
